Mark Teskey is Counsel in Fluet’s Government Contracts Practice, where he works closely with both government contractors and federal agencies on some of their most complex and high-stakes acquisition challenges. Whether that is navigating contract disputes, shaping acquisition strategy, or guiding major programs from concept to execution, Mark brings a practical, solutions-oriented approach grounded in real-world experience.
Before joining Fluet, Mark served in senior leadership roles across agencies like the Federal Aviation Administration (FAA), Department of the Air Force, Department of the Interior, and Department of the Treasury. Along the way, he advised senior political leaders, general officers, and program managers on everything from acquisition strategy and fiscal law to contract litigation.
Mark operated in traditional and non-traditional federal acquisition systems and leveraged the full statutory flexibilities in every system. He has overseen billions of dollars in federal contracting and led large, globally dispersed legal and acquisition teams. Mark delivers a broad, balanced perspective and creative problem-solving arising from his extensive experience. He also worked closely with government contractors and their counsel to seek equitable outcomes to the toughest issues.
Having spent years at the intersection of agency operations, budgeting, and acquisitions, Mark understands the tensions between industry and the government. He is deeply versed in how agencies think—how they assess risk, make decisions, and ultimately deliver results. He uses that insight to help clients navigate the full lifecycle of government contracts work, including bid protests, disputes, FAR/DFARS compliance, acquisition strategy, and small business programs. He also has deep experience with imaginative solutions, innovative procurement tools like Other Transaction Authorities (OTAs), and complex program structuring.
One of Mark’s most recent roles was as Assistant Chief Counsel for Acquisition & Fiscal Law at the FAA, where he led legal acquisition program and strategy for a $20 billion agency. He has extensive experience in fiscal law and provided the FAA’s authoritative finance and fiscal legal advice. During that time, he helped pave the path to modernizing the entire Air Traffic Control System leveraging commercial best practices—a projected $40 billion effort to be completed in just four years. Prior to that, he served as Director of Air Force Commercial Law and Litigation, managing a $60 billion contract protest and dispute litigation portfolio. He also led the Air Force Office of Small Business Programs, where he significantly expanded small business participation—from $8 billion to $18 billion over three years.
Mark is a retired Senior Executive and U.S. Air Force Colonel, having spent more than 23 years as a Judge Advocate and over 13 years as a Senior Executive. His military career included roles as General Counsel for the Air Force Office of Special Investigations, as well as serving as an acquisition attorney, program counsel, and federal court trial attorney.

Acquisitions & Strategy
- Led legal strategy for a $1.5 billion air system modernization integrator contract—completed and operational within six months with zero bid protests.
- Helped design and execute the legal and acquisition strategies for replacing the entire Air Traffic Control System—a $40 billion effort completed over four years using innovative acquisition approaches, commercial best practices, and OTAs.
- Shaped and implemented FAA acquisition policy, leveraging statutory flexibility and FAR independence to accelerate outcomes.
Small Business
- Directed Air Force small business programs, increasing spend from $8 billion to $18 billion in three years and strengthening the supply base.
- Established an executive acquisition oversight board at the Department of the Interior to drive collaboration and ensure compliance, while advising senior leadership on a $2.8B acquisition portfolio that surpassed federal small business participation goals.
Congressional Engagement and Testimony
- Provided Air Force testimony to Congress on Review Boards Agency operations, policy, and decision-making.
- Testified to Congress on Air Force small business programs; engaged Members and staff to address questions and align on program goals considering mission demands.
- Delivered testimony before the Senate Select Committee on Intelligence and the House Permanent Select Committee on Intelligence.
Litigation/Disputes/Conflict Resolution
- Oversaw $60 billion in administrative and federal court contract protest and dispute litigation for the Department of the Air Force.
- Intervened in a high-risk dispute involving a potential suspension and debarment of a major government contractor; led an independent assessment and fact-finding effort that enabled a mutually acceptable resolution, preserving over $9B in FAA contracts and broader government operations.
- Led resolution of complex software licensing and intellectual property issues across multiple vendors, structuring cloud and licensing agreements exceeding $700M to ensure uninterrupted FAA operations and mission-critical safety performance.
- Novel legal strategy resolved a $200M claim with a major defense contractor—avoiding prolonged litigation and ensuring timely delivery of a critical weapons system.
