In one of the first lawsuits under Virginia’s new Wage Theft Law, Fluet attorney Tom Craig withstood the defendant’s pleading for dismissal in court on behalf of our client. 

The client, who was an essential worker in the medical industry, was informed by the CEO of her place of employment in May that she would receive a monetary bonus on her July payroll in recognition of her efforts during the Covid-19 pandemic.

She later decided to leave her job in June and was never paid the promised bonus. Fluet attorneys assisted the client in suing her employer under the Virginia “Wage Theft Law”, which went into effect on July 1, 2020. 

Previous to the new law, employees could only file claims with the Virginia Department of Labor and Industry in all wage disputes and had no private rights to bring lawsuits in court. The Wage Theft Law grants all Virginia employees the right to hold employers accountable in court, along with other rights.

The defendant asked the court to dismiss the complaint. After hearing compelling arguments made by Mr. Craig, the court allowed it to move forward.
