Fluet is pleased to announce that Nick Rotsko has been appointed Chair of the firm’s Litigation + Investigations Practice. In this leadership role, Nick will guide the firm’s rapidly growing litigation team, which now encompasses complex business litigation, government contracts disputes, constitutional and administrative litigation, False Claims Act defense, and government investigations.

Nick focuses his practice on business litigation in the National Security space and lawsuits against the Government at all levels – state, local, and federal – including contract disputes, constitutional violations, and challenges to agency action.  Nick has a long track record of excellent results in “bet-the-company” breach of contract, business tort, corporate dissolution, and commercial real estate matters.

Nick’s litigation experience spans the U.S. Court of Federal Claims, where he previously served as a law clerk to the Honorable Victor J. Wolski, as well as federal and state courts nationwide. He has successfully litigated sizeable monetary claims against the federal government, defended False Claims Act allegations, conducted internal investigations, and managed complex e-discovery.

Nick also maintains an active constitutional and administrative litigation practice, asserting the rights of private parties against governments in civil rights disputes, preemption challenges, environmental and energy regulation, land use, and procurement matters. He has obtained federal court injunctions vindicating Second Amendment rights, prevailed in federal preemption lawsuits concerning interstate Natural Gas pipelines, and successfully challenged arbitrary and capricious agency action in a variety of contexts.

Prior to joining Fluet, Nick was a litigation partner in the Washington DC office of a full-service New York-based law firm, where he led the firm’s Government Contracts Practice and provided multidisciplinary strategic counseling. Prior to private practice, Nick worked as an attorney on judicial and cabinet-level nominations.
