Fluet’s Government Contracts team successfully prosecuted two separate bid protests at the U.S. Government Accountability Office (GAO) for a client that resulted in two different agencies within the U.S. Department of Health & Human Services taking highly beneficial voluntary corrective action.

In one protest, the agency cancelled the single award and stated that before resoliciting the procurement it would divide the requirement into two separate procurements. The contract at issue was valued at approximately $131 million, making the opportunity to recompete for a portion of that contract a highly positive outcome for our client.

In the other protest, the agency agreed to reevaluate our client’s proposal in light of the grounds alleged in the protest and make a new source selection decision. The opportunity to get a fair evaluation of its highly competitive proposal on this multiple award IDIQ contract put our client where it wanted to be — well positioned for an award. 

Each protest succeeded due to creative arguments making use of the facts of the particular procurement and relevant legal authority.
