The 2023 EEO-1 Component 1 data collection will open on Tuesday, April 30, 2024 and the deadline for submission is Tuesday, June 4, 2024. This deadline is much earlier than last year’s deadline in December, so covered employers should begin to compile and assess the required data as soon as possible. The EEO-1 Component 1 report is a mandatory annual data collection that requires certain employers to submit demographic workforce data to the Equal Employment Opportunity Commission (“EEOC”). Generally speaking, private sector employers subject to the Civil Rights Act of 1964 with 100 or more employees, and federal government contractors and subcontractors with at least 50 employees and a federal government contract of $50,000 or more are required to file their EEO-1 reports annually.
Our Fluet Government Contracts team has been monitoring updates for this year’s filing cycle subsequent to the many changes and updates made by the EEOC last year as part of its continuing modernization efforts. Similar to last year, the EEOC noted on its Announcements page of its website at https://www.eeocdata.org/ that it will publish the 2023 Component 1 Instruction Booklet (“Instruction Booklet”) and the 2023 Data File Upload Specifications by Tuesday, March 19, 2024, to be posted to www.eeocdata.org/eeo1. Those responsible for uploading the data for covered employers may also want to keep an eye out for any new postings of frequently asked questions (“FAQs”), in light of that fact that last year the EEOC published three volumes of FAQs.
The EEO-1 Component 1 reports must be submitted through the web-based portal, called the EEO-1 Component 1 Online Filing System. Employers may submit the required data either through manual data entry or through data file upload. We recommend that covered employers begin compiling and assessing their data as soon as possible in order to identify any issues or concerns that could impact their ability to meet the June 4, 2024 deadline.
