Mr. Carroll is a Partner in the firm’s Litigation + Investigations Practice, specializing in high-stakes matters involving congressional, criminal, government, and internal investigations, while also maintaining expertise in complex national security litigation. He provides sophisticated counsel to businesses navigating critical regulatory frameworks, including Committee on Foreign Investment in the United States (CFIUS), Foreign Investment Risk Review Modernization Act (FIRRMA), International Traffic in Arms Regulations and Export Administration Regulations (ITAR/EAR), Foreign Agents Registration Act (FARA), Foreign Corrupt Practices Act (FCPA), Foreign Intelligence Surveillance Act (FISA), Foreign Military Sales (FMS), National Industrial Security Program Operating Manual (NISPOM), Office of Foreign Assets Control (OFAC), and comprehensive cybersecurity compliance protocols.

Drawing from his distinguished public service career, he previously served as senior counsel to Homeland Security Secretary John Kelly and House Homeland Security Committee Chairman Peter King. His national security credentials include service as a Central Intelligence Agency (CIA) case officer, where he conducted critical operations in Iraq and New York. He also served as a law clerk to U.S. District Judge Thomas Platt in the Eastern District of New York.

In his military career, he served with distinction for thirty years in the Army and its reserve, culminating in his service as a deputy commander of the National Ground Intelligence Center. His extensive deployment history spans multiple theaters, including Bosnia, Hungary, Cuba, Afghanistan, Iraq and Yemen. He has held key positions in the Office of the Secretary of Defense, on the Joint Staff and Army Staff, and served as an intelligence officer for special operations units, including the National Missions Force. He maintains Top Secret/SCI-Q clearance.

A respected voice in national security and legal matters, he regularly contributes analysis and commentary to leading publications including Bloomberg Law, Law 360, The Wall Street Journal, and The Washington Post. His expertise is frequently sought by major media outlets such as CNN, Fox News, NBC News, The New York Times, and Politico. He is a sought-after speaker who addresses prestigious organizations including the American Bar Association, Association of Corporate Counsel, International Stability Operations Association, and U.S. Departments of State and Treasury. He maintains active involvement with Business Executives for National Security and Culper Connect.

Criminal Investigations

  • Representation of board members, charities, companies, donors, executives, professionals, a former prime minister, a congressional candidate, and a subcabinet officer in election law, Espionage Act, false statements, FARA, fraud, ITAR, public integrity, terror finance and violent crimes matters.
  • Representation of a hedge fund victimized by fraud, and an executive victimized by extortion.

Internal Investigations

  • Representation of a subcabinet officer, CIA and FBI officials and Defense, Energy, Homeland Security, and State Department officials in inspector general investigations.
  • Conducted or supervised investigations for a Fortune 250 defense contractor, a politically exposed person, a social media company, a university and a Swiss bank.

Congressional Investigations

  • Representation of Cabinet and subcabinet officers, CIA, military and naval officers, and an international sports organization in investigations by the Senate intelligence and commerce committees, and the House intelligence, judiciary, natural resources, and oversight committees.
  • Representation of a subcabinet officer in his Senate confirmation.
  • Led or participated as senior counsel to the U.S. House of Representatives Committee on Homeland Security in fifteen hearings, including on terror threats to and within the U.S. military; radicalization in U.S. prisons; and Iranian threats to and within the US (leading Tehran to issue an arrest warrant for a hearing witness).
  • Oversaw investigations into the admission of a designated foreign terrorist into the U.S.; plans to transfer 1993 World Trade Center bombing ringleader the “Blind Sheikh” to Egypt (which were thwarted); the failure to fully prosecute terror fundraising cases against the Holy Land Foundation; and leaks of classified information to the filmmakers of “Zero Dark Thirty” (resulting in a criminal referral).
  • Participated in investigations into the Boston Marathon bombing, additional 9/11 conspirators, and U.S. Secret Service misconduct in Colombia.

Civil Litigation

  • Representation of board members, companies, executives, a government-sponsored enterprise, national security officials,  and not-for-profits in Antiterrorism Act (ATA), commercial,  defamation, discrimination, First and Fifth Amendment, hacking, harassment, racketeering, Securities Act, Torture Victim Protection Act and trade secret theft matters.
  • Persuaded a federal judge to throw out a Marine whistleblower’s Board of Inquiry result under the Administrative Procedure Act.

National Security Regulatory Compliance

  • Obtained licenses to deal with sanctioned entities in the Democratic Republic of the Congo, and helped delist a sanctioned bank in Lebanon.
  • Representation of defense and Intelligence Community businesses before the Armed Services Board of Contract Appeals and the Government Accounting Office.

Public Policy

  • Representation of the first whistleblowers regarding CIA’s mishandling of sex crimes, leading to congressional and inspector general investigations, criminal convictions and statutory reforms.
  • Persuaded New York State’s governor and legislature, and New York City Council, unanimously, to amend civil service laws to allow an older Navy SEAL to join the FDNY; persuaded the Secretary of the Army to restore the rank of a wrongly demoted general; and obtained wrongly withheld awards for a Special Forces soldier paralyzed in Vietnam.
  • Helped obtain the release of a former Special Forces soldier held hostage in Iraq.
  • Helped obtain visas for, and resettle in the US, Afghan refugees whose family members helped American forces there.
  • Served as a media surrogate for a major party presidential nominee.
